21/07/2006Welcome to the second edition of the Coris quarterly newsletter. We have received positive feedback following our first edition, however if there is anything you would like us add to a future edition, do not hesitate to inform the Coris team.
Spotlight on: Macedonia
1.94 % of claims are settled out of court. The remaining 6 % are settled by court judgments, most of which involve serious injuries or fatalities.
As well as the PI element, claims can range from repairs to loss of use .Loss of use is settled (often for taxis and hire vehicles) in accordance with the evidence for reported turnover in the last three months.
2. Liability is determined by the Macedonian RTA. Many cases end up with liability being apportioned. Major pieces of evidence such as Police report, diagram and photographs are relied upon.
For minor material claims up to 750 Euros, the Agreed Statement of Facts has been used for the last two years. The reports by the Ministry of Internal Affairs, the ASF for minor material claims and the statements of the witnesses are particularly important.
3. According to Macedonian Law, the following claims can be made for personal injury:
- Pain and suffering and loss of amenity
- Aesthetic injuries (scarring) - the level of award depends upon the sex and the age of the victim .
- Loss of earnings
- Medical expenses
Solicitors costs are recoverable. The limitation period for damage only claims is 3 years, and 5 for personal injury claims, from the day of the accident. Where there has been a serious criminal offence, these limits can be doubled.

HPI FORMS
Following a meeting with Coris, one of our Clients suggested sending Coris a copy of the HPI form for any inspection cases. This has proven to be a valuable source of information. We would appreciate a copy of this when any new instructions are sent to Coris.

INTERESTING FACT
It was reported in a local newspaper that 110 years ago this week the first pedestrian in the world was fatally injured in a road traffic accident having been hit by a car. The accident happened in Crystal Palace, South London, and the driver was prosecuted for causing death by speeding and driving in a reckless manner, which was confirmed by a number of witnesses. The vehicle was travelling at 4 m.p.h. It is interesting to note that London traffic was faster in 1896!
