Coris News October 2006
21/10/2006Welcome to the third edition of the Coris quarterly newsletter. We hope the news we provide you is of use. Again we would like to stress, if there is anything you would like us to add to a future edition, do not hesitate to inform the Coris team.
Spotlight on: Poland
Third party liability claims are handled on the basis of the 2006 Compulsory Insurance Act, the Insurance Guarantee Fund and the Polish MIB.
I. The time limit for such claims is 30 days or 90 days (maximum) in case there is trial in progress and if this is necessary to establish the third party liability.
II. Material damage claims
Repair costs incl VAT or excl VAT - depending on whether the claimant is VAT registered. Payments with VAT are only paid upon receipt of the original invoices.
Total loss - (market value of the car minus salvage value)
- storage and recovery costs
- depreciation (only if the vehicle is less than 3 years old and if the owner proves that the car has not previously been involved in an accident)
- hire car and/or loss of use - where the claimant's vehicle was used for work purposes
- material damages (value minus depreciation)
III. Third party liability is determined by documents such as the police report, witness statements and any Court documents etc.)
IV. Personal injury claims (there are no tables to calculate compensation payments in Poland)
Compensation for personal injury - the damages are based upon:
- the percentage of the permanent disability
- duration of hospitalisation and the number of medical procedures undertaken
- age of the victim
- psychological and physical suffering
Compensation for personal injury is determined by art. 45 of the Civil Code and current jurisdiction concerning the reimbursement of:
- reasonable medical expenses and rehabilitation
- the doctor's journey to the claimant
- reasonable costs of any care claim
- reasonable costs of additional food requirements,
- loss of earnings
- Retraining where appropriate
- reasonable and documented costs of medication
- damaged personal property,
- reasonable costs of rehabilitation equipment
- annuity for loss of income, loss of opportunity on the job market and the increased needs of the victim
Personal injuries (deceased):
- reimbursement of documented funeral or gravestone expenses
- single compensation for the closest family members due to considerable living situation changes. This must be proven by the family members.
- compensatory payments due to death of the spouse or the children - such claims are considered individually upon receipt of documentary evidence.
Fully documented solicitor's costs are covered/reimbursed on condition that it is a regular claim.
20th BIRTHDAY
Next year we celebrate the 20th anniversary of the Coris
network. The annual Coris group meeting will take place in Paris.
2007 and beyond
In 2007 Romania and Bulgaria are joining the EU, with this free movement between the member countries we are likely to see a significant increase in claims involving vehicles from these new members.
Romania
22.3 million Population
An estimated 3.5-4 million vehicles
25% of these vehicles are estimated to be uninsured. Romania is currently undergoing a re-registration scheme and expects to reduce this to 12.4%.
Bulgaria
7.35 million Population
An estimated 3.3 million vehicles
29.4% or 0.72 million of these are estimated to be uninsured
